Product Emissions Standards Legislative Framework

From 1 July 2020, Euro Stage II certified products can no longer be imported into Australia under the transitional arrangements that commenced on 1 July 2018. For further information, refer to product emissions standards frequently asked questions.

The Product Emissions Standards Act 2017 commenced on 15 September 2017.

The Act establishes a national framework that allows Australia to address the adverse impacts of air pollution from certain products on human and environmental health.

The Act allows the Minister to prescribe emissions-controlled products and make Rules relating to those products. Under the Act, offences relate to the import and supply of emissions-controlled products in Australia if they have not been certified as meeting a standard, or are not marked in accordance with the relevant standard.

The legislative framework includes complementary legislation that: allows for a levy to be applied to the import or domestic manufacture of products; allows for the collection of information; and ensures that regulated products are not captured by mutual recognition arrangements.

  • Product Emissions Standards Act 2017 - Allows the Minister to make Rules that set emissions standards for products and details the administrative arrangements for regulating those products.
  • Product Emissions Standards (Customs) Charges Act 2017 – Allows for a Regulation to be made so that a levy can be imposed on products being imported.
  • Product Emissions Standards (Excise) Charges Act 2017 - Allows for a Regulation to be made so that a levy can be imposed on products domestically manufactured.
  • Product Emissions Standards (Consequential Provisions) Act 2017 – Allows for a consequential amendment to section 299 of the Customs Act 1901.
  • Trans-Tasman Mutual Recognition Act 1997 (amendment) – Allows for products captured by the Rules to be exempt from the Trans-Tasman Mutual recognition Arrangements.
  • Product Emissions Standards Rules 2017 – Sets the emissions for outdoor power equipment and marine engines and details the administrative arrangement on how those products will be regulated.
  • Product Emissions Standards (Customs) Charges Regulations 2018 – Sets the import levy.
  • Product Emissions Standards (Excise) Charges Regulations 2018 – Sets the domestic manufacture levy.
